Pennington v. Jones

Supreme Court of Louisiana

Decided June 15, 1900

Supreme Court of Louisiana · decided 1900-06-15

IN RE II. B. Jones et als. Applying for Certiorari, or Writ of Review, to the Court of Appeals, Eirst Circuit, State of Louisiana.

Decided 1900-06-15

Breaux, J.

¶1I concur in the decree. In my view it will now devolve upon the Court of Appeals to determine whether or not the sale is an absolute nullity.

¶2If the nullity be absolute (if the tax deed be void) then the prescript tion will not apply.

¶3If the nullity be not absolute (and the tax deed is not void) then prescription will be a bar to the action to set it (the tax title) aside.

¶4For these reasons I concur in the decree.
