Most-quoted passages

The sentences later courts lift from this opinion, ranked by how many decisions quote each — the parts of the opinion doing the work. These counts are smaller than the citation total above because most of the 5 citing decisions cite the case generally; a passage count includes only decisions quoting that exact language verbatim.

  1. ““ . . . The first proposition asserts that the trial court erred in allowing evidence of rape in the armed robbery case, and the armed robbery evidence in the rape case. We are of the opinion that the evidence of the other crime in both cases was properly admitted, and the same was part of the res gestae. We further observe that the same would be admissible under the exception to the general rule, that when a defendant is put on trial for one offense, he is to be convicted, if at all, by evidence which shows that he is guilty of that offense alone, and the admission of evidence of other crimes, either prior or subsequent to the offense for which he is on trial, is inadmissible.””

  2. ““ . . . where proof of one offense forms the res gestae, such as in the instant case, the evidence is not inadmissible when it tends to prove defendant’s guilt of the offense on trial although it may also prove him guilty of another offense.””
