¶1AFTER REMAND BY ALABAMA SUPREME COURT

TYSON, Judge.

¶2This court has carefully considered all contentions of error raised in the trial court. After examining the record and upon authority of Ex Parte David Phillips, *158527 So.2d 154 (Ala.1988), this cause is affirmed.

¶3AFFIRMED.
