Torres v. State

District Court of Appeal of Florida · decided 1988-07-22

Decided 1988-07-22

PER CURIAM.

¶1Appellant appeals his sentence as an improper departure from the guidelines. We agree. None of the reasons for departure given by the trial judge comport with the permissible reasons as approved by the appellate courts of this state. We therefore reverse appellant’s sentence and remand for resentencing within the guidelines.
