Relies on State v. Laird

Decided 1988-09-09

¶1In re Laird, Roger; applying for writ of certiorari and/or review; to the Court of Appeal, Third Circuit, No. CR87-0947; Parish of Concordia, 7th Judicial District Court, Div. “B”, No. 87-0081.

¶2Prior report: La., 525 So.2d 184.

¶3Granted and remanded for resentencing. The trial judge’s reasons indicate he may have thought he was bound to impose a sentence of actual imprisonment. Since this would have been legal error, the trial judge is directed to resentence the defendant.
