Relies on 246 So. 2d 771 - Richardson v. State · 464 So. 2d 609 - Donahue v. State

Decided 1988-11-02

PER CURIAM.

¶1After review of the record, we conclude that the trial court erred in failing to conduct an adequate Richardson inquiry before admitting into evidence for impeachment purposes, a photograph which had not been disclosed in discovery. See, e.g., Richardson v. State, 246 So.2d 771 (Fla. 1971); Donahue v. State, 464 So.2d 609 (Fla. 4th DCA 1985).

¶2The convictions and sentences are therefore reversed and remanded for a new trial
