Most-quoted passages
The sentences later courts lift from this opinion, ranked by how many decisions quote each — the parts of the opinion doing the work. These counts are smaller than the citation total above because most of the 18 citing decisions cite the case generally; a passage count includes only decisions quoting that exact language verbatim.
“Criminal Rule 404(a)(1) is in accord with a well-recognized exception to the rule against the use of character evidence for this purpose and is consistent with the prior criminal practice of limiting the evidence to a “pertinent” trait, i.e., one that relates to a trait involved in the offense charged or a defense raised. Presumably, the appellate courts will continue to carefully scrutinize attempts by the prosecution to open the door as to the defendant’s bad character by attempting to get the defendant to inject evidence of his good character during cross-examination. The Court of Criminal Appeals has held that the state can not rely on its own questioning as an invitation to rebuttal.”
