¶1In an action to recover damages for legal malpractice, defendant appeals from an order of the Supreme Court, Kings County, dated February 19, 1976, which granted plaintiffs’ motion for partial summary judgment. Order reversed, without costs or disbursements, and motion denied. The record before us presents questions of fact which cannot be decided summarily and which require a plenary trial. Latham, Acting P. J., Margett, Rabin, Titone and Hawkins, JJ., concur.
