¶1ON RETURN TO REMAND
¶2On remand, the trial judge set aside Bu-channon’s conviction of burglary in the first degree, adjudged him guilty of burgla*569ry in the third degree, and sentenced him as a habitual offender to thirty-five years’ imprisonment. The judgment of the Lee Circuit Court is hereby affirmed.
