The newspaper's defense that the findings of such reports were news items was rejected, since the newspaper was found to have violated copyright through substantial similarities with the expression used in the Wainwright reports.

The courts determined that "the University, acting here as an instrumentality of the State, has no right to restrict speech or association 'simply because it finds the views expressed to be abhorrent'."
