Arcia v. Morphonios

¶1Upon consideration, respondent’s motion to vacate is granted and the opinion of February 6, 1990 is hereby vacated and withdrawn. Petitioner’s motion for this court to obtain jurisdiction of the petitioner’s Rule 3.850 motion for post-conviction relief is granted as a belated appeal of the trial court’s order dated June 21, 1989, denying petitioner’s motion under Rule 3.850 without an evidentiary hearing.
