¶1ON REMAND FROM THE ALABAMA SUPREME COURT
¶2Pursuant to the Alabama Supreme Court’s decision in Brooks v. State, 562 So.2d 604 (Ala.1990), the judgment is reversed and the case is remanded to the circuit court for a new trial.
¶3REVERSED AND REMANDED.
