Cain v. State

District Court of Appeal of Florida

Decided October 17, 1990

District Court of Appeal of Florida · decided 1990-10-17

Decided 1990-10-17

PER CURIAM.

¶1While the record in this case strongly suggests that appellant is entitled to relief, the appropriate vehicle is a motion under rule 3.850, Florida Rules of Criminal Procedure, rather than by way of direct appeal.

¶2Accordingly, we affirm without prejudice to the filing of such a motion in the lower tribunal.
