Schaff, is the receiver duly appointed, qualified, and acting of the property of the Missouri, Kansas & Texas Kailway Co. of Texas, a corporation organized under the laws of the State of Texas, and now operates the system of railways formerly and for a long time operated by the said corporation in the State of Texas.

The Reporter’s statement of the case: The following are the facts of the case ae found by the court: I. In the latter part of October, 1918, the plaintiff, Clarence D. Rigsbee, was the owner of a 10-ton Kelly Springfield steam road roller, which was then at Camp Lee, near Peters-burg, Ya., and for a time theretofore had been in use by a contractor on Government work at that camp at a rental of $250 per month.
