Benjamin v. State

District Court of Appeal of Florida · decided 1992-03-04

Decided 1992-03-04

PER CURIAM.

¶1The public defender has filed an Anders brief in this case. However, Darrell Benjamin, pro se, raises two points in this appeal. As to his first point on appeal, the supplemental record filed with this court shows that, contrary to appellant’s assertion, the jury was instructed on the lesser offense of petit theft. We also reject appellant’s contention that there was insufficient evidence of burglary.

¶2Affirmed.

SCHOONOVER, C.J., and CAMPBELL and HALL, JJ., concur.
