¶1after stating the foregoing facts delivered the opinion of the court.

¶2The findings of fact and conclusions of law contained in the judgment appealed from are accepted.

¶3Having examined articles 778, 794 and 1081 of the Oivil *233Code, we adjudge that we should affirm and do affirm the judgment appealed from, with costs against the appellant.
