¶1This Cause coming this Day to be heard upon the Defendant’s Plea to the Complainant’s Bill Upon Debating the matter and Hearing what could be said by Counsel learned on both Sides, This Court is of Opinion that as the Matter was not Referred to the Master before the Cause was Set down for Hearing Therefore Ordered that the Said Defendants plea be allowed and the Plaintiffs Bill Dismissed with Costs to be Taxed by the Master of this Court.
