¶1(concurring).
¶2I agree that the abandoned weapon should not have been suppressed. We have not decided, however, that the defendant is the person who abandoned the weapon — an issue which the trial judge concluded was not established by the evidence. Resolution of that question, we hold here, was not appropriate on a motion to suppress.
