¶1dissenting:

¶2I respectfully dissent to this decision for the reason I believe the entire array of jurors was prejudiced toward the defendant by what the judge said in their presence. There are other provisions for the punishment of an absent defendant other than making prejudicial remarks in the presence of the jurors, as was done in this ease.
