WARREN, J.

¶1 (dissenting).

¶2 I cannot agree with the majority opinion for the reason that the issues involved in the trial were presented to the jury upon evidence which, in my opinion, was ample to sustain its verdict. I am mindful of the objections urged against Exhibit X, but am unable to agree that its admission was prejudicial. I do not believe that the verdict, should be disturbed.
