Most-quoted passages
The sentences later courts lift from this opinion, ranked by how many decisions quote each — the parts of the opinion doing the work. These counts are smaller than the citation total above because most of the 41 citing decisions cite the case generally; a passage count includes only decisions quoting that exact language verbatim.
““It is well settled that where an offense is one continuous transaction, or another offense is part of the ease on trial, proof of all facts relating to the transaction or other offense is proper as part of the circumstances attending the offense.... Such an extraneous transaction is admissible to show the context in which the instant offense occurred under the reasoning that events do not occur in a vacuum and the jury has a right to hear what events immediately surrounded the criminal act charged so that they may realistically evaluate the evidence.... ””

(Citations omitted). Such an extraneous offense is admissible to show the context in which the criminal act occurred; this has been termed the “res gestae,” under the reasoning that events do not occur in a vacuum and that the jury has a right to hear what occurred immediately prior to and subsequent to the commission of that act so that they may realistically evaluate the evidence. (Citations omitted).”
