In the year 1852 the plaintiff in error, Robert Miller, was appointed by the Probate Court of Knox County, administrator do bonis non with the will annexed of the estate of James Morrison, deceased, late of that county. In the year 1862 Miller filed a partial account as administrator, which was duly approved.
