¶1Dissenting.

¶2I respectfully dissent from the majority opinion. I do not believe that an attorney, who files a rule with an order attached for a hearing date, can walk away and later contend that he had no notice of the rule which he provoked. I submit that the majority erred in reversing the trial court judgment dismissing the disavowal action.
