Appeal by James W. Todd and others from so much of the-decree of tbe Surrogate’s Court of tbe county of Westchester, dated on tbe lltb day of January, 1890, as authorized and directed the executor, Edward A. Robinson, to pay and distribute the balance in his hands, $6,812.44, in three equal shares, to Edward A. Robinson,. Hannah M. Stanton and Emma P. Robinson, which decree was-filed in the office of the surrogate of the county of Westchester on the 31st day of January, 1890.

Appeal by Alfred C. Hodgman, as assignee, etc., of diaries Hooper, from an order entered in the office of tbe clerk of tlie county of Washington on the 8th day of January, 1890, by which it was adjudged by the county judge of Washington county that the claimant, Byron O. Spencer, was entitled to a preference under the statute in payment of his claim out of the assets of the estate of Charles Hooper, who had made an assignment thereof for the benefit of his creditors.
