¶1The following order has been entered on the motion filed on the 11th day of May 2006 by Defendant to Dismiss With Prejudice Pursuant to N.C.G.S. 15A-1443(a)(b)(c) and N.C.G.S. 15A-954(a)(I)(4)(7):
