¶1Granted. The ruling of the court of appeal is vacated. The case is remanded to the district court for reconsideration of defendant’s request for the court to appoint a mitigation expert in light of State v. Touchet, No. 93-KK-2839 (La. 9/6/94), 642 So.2d 1213.
¶2The date of the capital trial, presently set for September 27, 1994, is to be refixed by the district court.
