¶1concurring specially.
¶2I dissented from the majority opinion in Sapio’s direct appeal because I believed then, as I believe now, that under the Supreme Court’s holding in State v. Moore, 485 So.2d 1279 (Fla.1986), the evidence was legally insufficient to convict Sapio. I therefore concur in the result reached by Judge Harris.
