  1. “At the retrial, the jury should be instructed (1) that both Mr. Viera and the defendant were negligent causes of Mr. Viera's death; (2) that it should determine whether Dade County was also a negligent cause of Mr. Viera's death; and (3) that, if it finds against the County on that issue, it should apportion the blame between Mr. Viera, the defendant, and the County.
