¶2I agree with the underlying position taken by Judge Buttler, and were it not for Forman v. Clatsop County, 63 Or App 617, 665 P2d 365 (1983), I would join in his dissent. However, until it is reversed, that decision governs the disposition of the issues raised in this case.
