<bold>No. 02SC6</bold>, <bold><underline>People v. Sepulveda</underline></bold> <bold>Prosecutor entitled to elect</bold><bold>resentencing on lesser included offense</bold> In this case, the court of appeals reversed Walter A. Sepulveda's first-degree murder conviction, because of an error relating to a jury instruction. The People anticipated reversal of the conviction based upon the supreme court's decision in<underline>People v. Harlan</underline>, <cross_reference>8 P.3d 448</cross_reference> (Colo. 2000), and requested that the court of appeals afford the prosecutor the option of either conducting a new trial or accepting a judgment of conviction on the lesser included offense of second-degree murder. The court of appeals declined the People's request, and remanded the case for a new trial. <underline>People v. Sepulveda</underline>, No. 00CA762 (Colo.App. Nov. 8, 2001) (not selected for official publication). The supreme court accepted certiorari, and now reverses the court of appeals in part. Specifically, the court holds that where the evidence at trial clearly sustains all of the elements of the crime of murder in the second degree, it is proper to grant the prosecution the discretion to retry the case or, alternatively, to request the court to resentence the defendant for the lesser offense. Here, the court concludes that the evidence established that Sepulveda knowingly caused the death of another person, and that Sepulveda was not entitled to jury consideration of provocation. Accordingly, the court reverses the court of appeals in part and returns the case to the court of appeals for remand to the trial court, where the People may elect either to request a conviction for second-degree murder, or to retry the defendant.<page_number>Page 1004</page_number>
