¶6Pursuant to the Opinion of the Supreme Court in Ashcroft v. al-Kidd, — U.S. —, 131 S.Ct. 2074, 179 L.Ed.2d 1149 (2011), the district court’s denial of Defendant Ashcroft’s motion to dismiss pursuant to Fed.R.Civ.P. 12(b)(6) is REVERSED, and the matter is REMANDED for proceedings consistent with the Supreme Court’s Opinion.
