¶1We affirm the order under review, but remand for clarification. Specifically, the trial court’s order should clearly indicate that the seller is required to pursue the action to quiet title in good faith. The order should also indicate that if the seller does not prevail in the action to quiet title, the buyer then has the option of either receiving a return of his deposit or accepting title to the property subject to the easement.
¶2Affirmed and remanded with directions.
