<bold>[1] Appeal and Error — Notice of Appeal — Time of Filing.</bold> Compliance with ROA 33, which requires the filing of a notice of an appeal from a judgment within 30 days from the entry thereof, is a jurisdictional step in the perfection of an appeal; and since the rule requires actual filing of the notice within the 30-day period, it is not sufficient that the notice was deposited in the mail within such period. <bold>[1] Divorce — Child Support — Source of Support — Child's Estate.</bold> Until it is established that the parents are unable to support the children, it is improper to invade the estate of minor children by providing for their care and support from the funds of a trust created by a nonparent and restricted in use for their future education, since the support of children is the primary obligation and duty of a parent. <bold>[2] Same — Disposition of Property — Community or Separate</bold> <bold>Property.</bold> In a divorce action, the court has jurisdiction to make an equitable division of both separate and community property, and the characterization of the property as "separate" or "community" is not necessarily controlling.
