1. ““The objection to the acknowledgment is, that it does not appear to have been taken before an officer known to the laws of this state; and that it does not appear of what county the officer making the certificate was circuit clerk. ‘ Circuit clerk ’ is the title by which the clerk of the circuit court is ordinarily designated both by lawyers and laymen, and while, as an official designation, it is not rigorously exact, yet being in common use and reasonably certain, we are of opinion that it sufficiently identifies the officer taking the acknowledgment as the clerk of the circuit court. We aré also of opinion that it sufficiently appears from the face of the certificate that the person taking the certificate was circuit clerk of Schuyler county. The venue of the certificate is ‘State of Missouri, Schuyler county.’ This shows that the certificate was granted in Schuyler county, and the presumption is that the officer exercised his functions within fiis jurisdiction.””
