¶2In my opinion, defendant’s appeal was not timely made. I respectfully disagree with the majority decision as to the requirements of N.C. Gen. Stat. § 1A-1, Rule 58 of the Rules of Civil Procedure (1982), and vote to dismiss the appeal.
