¶2dissenting.

¶3Because our recent review presented this Court with a serious question concerning the State’s withholding of evidence of another suspect, and was decided by a 4-3 vote of the Court, I would afford the appellant an opportunity, albeit on an expedited basis, to present argument on this appeal before deciding the merits.
