¶1ON REHEARING

WICKER, Judge.

¶2We granted rehearing of this matter to reconsider our decision which affirmed the trial court’s judgment enjoining the appellant’s attempt to obtain a zoning variance.

¶3After reviewing the matter on rehearing, with supplemental briefs and oral argument by the parties, we decline to change our decision. Our judgment of April 9, 1997 is hereby reinstated.

¶4JUDGMENT OF APRIL 9, 1997 REINSTATED.
