¶3concurring.

¶4As I appreciate the issue involved as to which the court of appeal and this Court have denied writs, it has to do with the trail court’s ruling simply allowing the State to obtain additional chemical testing. What may develop at the time the result of that testing is offered through testimony or otherwise at trial remains to be seen — including what may develop by way of defense counsel’s request for its own opportunity to have the evidence tested.
