<bold>[1] Criminal Law — Plea of Guilty — Withdrawal — Discretion of</bold> <bold>Court.</bold> There is no constitutional right to withdraw a plea of guilty and to enter a plea of not guilty, but such a motion is addressed to the sound discretion of the court, the exercise of which will be set aside only upon a clear showing of abuse of discretion. Before a trial court will be held to have abused its discretion, the record must show that the discretion exercised by the court was predicated upon grounds clearly untenable or manifestly unreasonable. <bold>[2] Same — Plea of Guilty — Withdrawal — Abuse of Discretion.</bold> It was not an abuse of discretion to deny a motion to withdraw a plea of guilty made at the time of a hearing on a petition for revocation of parole, where the record established that at the time the plea of guilty was entered, the accused was represented by able and experienced counsel, entered the plea voluntarily, and had full knowledge of the nature of offense charged and the consequences of the plea. <bold>[1] Criminal Law — Evidence — Failure to Challenge Admissibility</bold> <bold>— Effect.</bold> Failure to challenge the admissibility of proffered evidence constitutes a waiver of any objection to its being considered as proper evidence by the trier of facts. <bold>[2] Searches and Seizures — Appeal and Error — Review — Issues</bold> <bold>Not Raised in Trial Court.</bold> Error predicated upon use of evidence allegedly obtained by an illegal search and seizure cannot be raised for the first time on appeal. <bold>[3] Appeal and Error — Reservation of Grounds — Exceptions to</bold> <bold>Instructions.</bold> Instructions given without exception taken thereto become the law of the case and are not subject to review upon appeal, except when the failure to consider the alleged error would constitute a grave miscarriage of justice. <bold>[4] Criminal Law — Right to Counsel — Presumption of</bold> <bold>Qualifications.</bold> An attorney who has been admitted to practice law in this state is presumed to be of sufficient skill and learning to adequately defend a person accused of a crime. <bold>[5] Same — Right to Counsel — Mistakes of Judgment — Effect.</bold> Decisions such as whether to move to suppress evidence and to approve instructions are matters for the discretion of trial counsel, and, if the choices are wrong, they do not establish the violation of a constitutional right, since the constitution guarantees a defendant a fair trial, not a perfect trial.
