¶1CONFESSION OF ERROR

PER CURIAM-

¶2The appellee Cape Inc. Construction & Development1 having filed a confession of error, which confession the court finds to be proper, the summary judgment entered by the trial court in favor of Cape, Inc. Construction & Development is hereby reversed and the cause is remanded for further proceedings.

¶3. Although there are other appellees, Cape Inc. Construction & Development is the only party appellee affected hereby.
