¶1concurring:

¶2I concur in the result. I differ with the majority in that it has gone further than I would in instructing the trial court as to how to establish an appropriate award of counsel fees. The verdict in this case was nominal at best and the claim for counsel fees can only be considered excessive in relation to the success achieved. I believe the trial court should not be restricted in the exercise of his discretion in establishing an appropriate fee.
