¶2I concur in the portion of the opinion that affirms defendant’s conviction. I dissent from the portion of the opinion that vacates defendant’s sentence for the reasons expressed in my dissent in State v. Freeman, 705 N.W.2d 286 (Iowa 2005) (filed today).
