¶1This cause is pending before the court as an appeal from the Court of Appeals for Stark County. Upon consideration of the motion of Sondra Thottam, n.k.a. Cain, for reconsideration of the dismissal of her cross-appeal for want of prosecution, see 71 Ohio St.3d 1442, 643 N.E.2d 1152,
