¶2On the authority of Lindley v. State, 728 So.2d 1153 (Ala.1998), the judgment of the circuit court is reversed and this cause is remanded to the Circuit Court for Franklin County for proceedings consistent with the Supreme Court’s opinion.
¶3REVERSED AND REMANDED.
