¶1Affirmed,' with leave to petitioner-appellant to amend his pleadings before the Honorable Henry C. Tillman, Circuit Judge of the Thirteenth Judicial Circuit of Florida, in such manner as to create the issue of whether or not petitioner-appellant is a fugitive from justice in accordance with' the case of Kuney v. State, 88 Fla. 534, 102 So. 547.
