¶1concurring.

¶2The present prosecution in this case is plainly vindictive. Thus, I would hold that it also violates Williams’ right to due process of law, as guaranteed by the Alaska Constitution. Atchak v. State, 640 P.2d 135, 140-51 (Alaska App.1981); Alaska Const. art. I, § 7.
