“The principle that title insurance is a contract of indemnity, not a guaranty of the state of title, is not only inherent in the policy here but is recognized generally by the courts in cases involving both the owner's and the mortgagee's title insurance. * * * To trigger the duty to indemnify, the insured must have a claim asserted against the title by a third party because an `indemnity is a * * * collateral promise to make good a loss or injury suffered by a policyholder in consequence of the act of a third party.'
