¶1(dissenting in part). I agree that there must be a reversal because defendant was absent during a material part of the trial. I disagree, however, for the reasons stated by Judge Bellacosa in dissent, that the kidnapping count of the indictment should be dismissed. I would direct a new trial on all counts.
