¶1Conviction is for unlawfully selling spirituous liquor capable of producing intoxication; punishment being assessed at one year in the penitentiary.

¶2Appellant has filed his affidavit with this court advising that he does not further desire to prosecute his appeal, and at his request the appeal is dismissed.
