¶1The conviction is for the unlawful possession of intoxicating liquor for the purpose of sale; penalty assessed at confinement in the penitentiary for five years.
¶2It has been made known to this court by proper affidavit that appellant died October 7, 1934, after having perfected his appeal. The death of the appellant deprives this court of jurisdiction of the appeal. It is therefore dismissed.
